Has anyone ever been to court for not paying back a payday advance loan?
I owe 126$ and this payday place is threatning to take me to court if i do not pay them the full amount within 2 days.Does anyone know if they really can take you to court for such a small amount?Wouldnt they be paying more to take me to court than what i owe them?What can happen if i do not pay them back?

Well many people that goes to collections … Sometimes you only have to pay such a little payment … And most of this people take this payments just so they can have their money back at least

Check your states rules on payday loans some have outlawed them and the borrower does NOT have to pay them back.
I’ve had good results here…

Yes, they can take you to court. You signed an agreement when you took out the “loan”, just like a contract. They would sue you for the amount owed and court costs.

I know it may seem like a very small amount to me and you, but to them it is their business. What they would do is sue you for that amount by going to small claims court or something like that. Then they would sue you for the court costs. This basically makes you pay for their time and pay back the loan.

Just pay them something….whatever amount you can afford, no matter how small. It shows your intent to pay and may prevent going to court. If you do go to court, they will demand you pay as you can. BUT, if you make a small payment now, it reduces your “crime” to slow payment rather than a “failure to pay”.

They can take you to court, but I doubt very much that they will for only $126. For such a small sum, pay them the money.
